been married since march 2008 but student visa expired 5 months ago?
question,
me and my husband (german citizen) are legallymarried since march 2008. his student visa expired in may 2008. Now, after 5 months, i finally saved enough money to get a lawyer and to start his application process for his immigration.
I’ve been reading the worst things on different forums and now we are really concerned that that will affect his immigration process or that he will even be deported.
any thoughts or facts?

he gratuated 5 months ago n is currently not enrolled in school, his I-20 is valid until 2009.
Even if he overstayed his visa you can still adjust his status. Unless he has been convicted of a felony or has a bad criminal record you don’t have much to worry about.
