gave birth in the USA – what are my imigration rights?
coming from europe, we are here on a working visa – for 3 years so far (considered “residents”). we conceived and had a baby here, who is now US citizen of course.
now we are thinking about staying here for good, cause we love america!
what are our rights? should i go to the USCIS and talk to them or a lawyer – what to do?
thanx
The last two previous answers are correct:
giving birth to a US citizen does not afford you any immigration benefits. If you are temporary residents based on nonimmigrant working visas, your employer (or another one) must petition for your immigration to work for them permanently;
your child could petition for you, but only after she/he reached the age of 21.
