Holding political …
Holding political office in the US does not “automatically” terminate US citizenship. In fact, it’s virtually impossible to do anything to automatically cause loss of US citizenship.
Holding such a position MAY cause loss of US citizenship, but only if done with the intention to give up citizenship, and the burden of that intent is on the State Department. Additionally, intent must be proven by actions other than the mere acceptance of the foreign government position.

i wish if somoene can answer me with this question, my I-130 was received on april 19, 2002 to the INS to be sent forward to Vermont, its I-130 US citizen to brother. now on the INS case status, it says the application has been transferred to the local INS office ( vermont) and vermont is processing MARCH 19′2001 application to date, current PD is Dec98. any thoughts on that??????

Mr Bernstein misstakes US law on loss of US nationality. He states incorrectly that any person who accepts a position as an official of a foreign government automatically loses US citizenship. Accepting such a post is potentially expatriating under under 8 USC ยง 1481(a), but can only result in loss of US citizenship if done with intent to renounce US citizenship. Though the State Department has presumptions in practice, the legal burden is on it to show evidence of the renunciatory intent.

Taking office in another country does not “automatically” terminate US citizenship. US citizenship will be lost if, and only if, it was the person’s intention to give it up. If his intention was to keep it, then it will not be lost.
